The Future of Vaccine Mandates Will Likely Come Down to Brett Kavanaugh and Amy Coney Barrett

posted on October 26, 2021

Ian Millhiser of Vox reports on the uncertain future of vaccine mandates at the Supreme Court. An upcoming case, Does v. Mills, could overturn Maine’s requirement that all healthcare workers be vaccinated, regardless of religious objection. Millhiser writes, “One reason why this case is potentially troubling, moreover, is that if religious exemptions to vaccination are allowed, it will be very difficult to prevent people with political or other nonreligious objections from claiming religious motivations for their opposition to the vaccine.” Justices Brett Kavanaugh and Amy Coney Barrett remain the most likely to sway the outcome, given the rest of the court’s already-established positions on the issue of religious exemptions.
