Supreme Court Divided as It Hears Argument on Contraceptive Coverage

Robert Barnes of The Washington Post reports, “A divided Supreme Court seemed inclined to agree Tuesday that the religious beliefs of business owners may trump a requirement in President Obama’s Affordable Care Act that they provide their employees with insurance coverage for all types of contraceptives.” However, Justice Kennedy, who often holds the balance in the court, made several remarks that seemed to favor the government, but also appeared concerned that there was little employers could do to object to funding. Kennedy told Solicitor General Donald B. Verrilli Jr. that corporations “could be forced in principle to pay for abortions.”
