Kavanaugh, Barrett Air Skepticism of Texas Abortion Law

Josh Gerstein and Alice Miranda Ollstein of Politico report that two conservative Supreme Court justices had tough questions about Texas’s restrictive abortion law during oral arguments. They write, “Two appointees of President Donald Trump — Justices Brett Kavanaugh and Amy Coney Barrett — raised the hopes of abortion rights advocates with their questions in Monday’s arguments. Both aired concerns that Texas’ abortion ban was designed to evade federal law and constitutional review.” The issues in oral arguments largely centered around procedural questions rather than the right to abortion, which is set to be litigated in a separate case later this term. The Texas law, which bans abortion after six weeks, continues to be in effect while the justices deliberate.
