Supreme Court Rules Against Abercrombie in Hijab Case

For POLITICO, Marianne Levine reports the Supreme Court ruled on Monday that Abercrombie & Fitch could not decline to hire a job applicant solely because she wore a head covering. Abercrombie argued that its “look policy” banned “all types of headgear and therefore was not based on religion,” Levine writes. In the court opinion, Justice Antonin Scalia wrote, “An employer may not make an applicant’s religious practice, confirmed or otherwise, a factor in employment decisions.”
