Court Confronts Religious Rights of Corporations

Adam Liptak of The New York Times reports that on Tuesday the Supreme Court is expected to decide if it will hear the Obama administration’s appeal of a federal court ruling in favor of Hobby Lobby. Hobby Lobby is in noncompliance with the Affordable Care Act because it argues that providing insurance coverage for certain contraceptives is a violation of its religious beliefs. The Obama administration argues that a for-profit corporation cannot be established as a religious organization. Liptak writes, “Legal experts say the court is all but certain to step in, setting the stage for another major decision on the constitutionality of the Affordable Care Act two years after a closely divided court sustained its requirement that most Americans obtain health insurance or pay a penalty.” University of Virginia law professor Douglas Laycock notes, “The stakes here, symbolically and politically, are very high.”
